Proving (or Defending Against) Adultery Allegations in Court 

Trying to prove your spouse cheated? Or being accused of it yourself? Either way, you need to understand how adultery is proven in a Virginia courtroom. 

The law requires clear and convincing evidence, and that is a high bar. You do not need a smoking gun, but you do need more than suspicion. Things like: 

  • Consistent late-night calls or texts 

  • Overnight trips or hotel stays 

  • Photos, videos, or social media clues 

  • Eyewitnesses who saw more than just a hug 

Defending against an adultery claim?

You may be able to show the relationship was not sexual, or that there is not enough evidence.

 If both spouses cheated, that can cancel out the claim (a defense called recrimination). 

Do not respond without legal advice. Adultery claims can impact custody, support, and your reputation.
