D.C. Eliminates Waiting Period for Divorce: What You Need to Know

In a landmark change, Washington, D.C., has officially removed the waiting period required to file for divorce. As of January 26, 2024, the “Grounds for Divorce, Legal Separation, and Annulment Amendment Act of 2023” has gone into effect, streamlining the divorce process for residents. This update represents a significant shift in family law for the District, making it faster and more accessible for individuals to end their marriages.

What Has Changed?

Previously, D.C. law required couples to live separately for six months (if mutually agreed) or one year (if contested) before they could file for divorce. This separation period often prolonged the emotional and logistical challenges of divorce, even in cases where both parties were ready to move on.

Under the new law, couples no longer need to wait to begin the legal process. A divorce can now be granted based solely on one or both parties stating that they no longer wish to remain married.

Additional Protections and Changes

The law does more than just eliminate the waiting period. It includes important updates designed to protect vulnerable parties and ensure fairness:

  1. Consideration of Abuse:
The court must now take into account any history of physical, emotional, or financial abuse when determining spousal support, property division, and other key aspects of divorce.

  2. Exclusive Use of the Marital Home:
Judges have the authority to grant one spouse exclusive use of the marital home during divorce proceedings, even if the property is not jointly owned. This provision offers critical relief in contentious or abusive situations (D.C Law 25- 15).

  3. Streamlined Process:
By removing the waiting period, the law allows for quicker resolution of uncontested divorces, reducing stress for all parties involved.

Why This Matters

This change is especially impactful for individuals in abusive relationships or those seeking a swift resolution to end their marriage. By eliminating the waiting period, D.C. aims to reduce the emotional burden of prolonged separations and provide greater autonomy for individuals to move forward with their lives.
